What a Florida Prenuptial Agreement Can Cover

Florida’s Uniform Premarital Agreement Act, codified at Florida Statute 61.079, governs premarital agreements entered into on or after October 1, 2007. Under this statute, spouses can contract about rights and obligations in property each brings to the marriage or acquires during it, including how that property is managed, controlled, and distributed upon separation, divorce, or death. A premarital agreement can also address spousal support, life insurance beneficiary designations, estate planning matters, and which state’s law can govern the agreement itself.

One area the statute specifically excludes is child support. The right to support belongs to the child, not the parents, so no premarital agreement can waive or predetermine it. A judge determines the appropriate amount at the time of divorce based on the child’s needs and circumstances as they exist then. Child custody works the same way in practice. Florida courts decide parenting and timesharing arrangements based on the child’s best interests, regardless of what a premarital agreement might say.

Enforceability: What Makes a Florida Prenuptial Agreement Valid

Florida law requires a premarital agreement to be in writing and signed by both parties. No consideration beyond the marriage itself is required to make it binding. Full financial disclosure isn’t a strict requirement for enforceability, but if a party later challenges the agreement as unconscionable, the court will look at whether fair and reasonable disclosure was given or expressly waived in writing.

A court won’t uphold an agreement if the opposing party can show it was signed under fraud, duress, coercion, or overreaching, or that it was unconscionable when executed and disclosure was inadequate at the time. Unconscionability, in plain terms, means the agreement was so one-sided that enforcing it would be fundamentally unfair. Florida doesn’t require notarization or independent legal counsel for each party, but having your own attorney review the agreement before signing is evidence that you understood what you were agreeing to and signed voluntarily.
