Why Military Divorce Is More Complex Than a Standard Florida Divorce

Military Retirement Pay & the USFSPA
The Uniformed Services Former Spouses Protection Act (USFSPA) is the federal law that authorizes state courts to treat military retirement pay as marital property and divide it in divorce proceedings. Without it, a Florida court would lack authority to award a former spouse a share of a military pension. With it, the pension is subject to Florida’s equitable distribution rules, meaning the court divides it based on the circumstances of the marriage.
One rule that applies directly to payment logistics is the 10/10 Rule. A former spouse qualifies to receive direct payment from the Defense Finance and Accounting Service (DFAS) only when the marriage lasted at least 10 years and the service member performed at least 10 years of creditable military service during that marriage. If the marriage doesn’t clear that threshold, the pension award is still enforceable, but the former spouse must collect through other legal mechanisms rather than directly from DFAS. The marital share of the pension is calculated based on the years of marriage that overlapped with the period of military service, making accurate record-keeping essential to reaching the right number.
